Canadian Insolvencies

New YorkWith our business expanding across international borders in recent years, we have developed a strong presence in the Canadian insolvency and bankruptcy markets, and have found success in providing liquidity to creditors involved in these north-of-the-border filings.

Whether a debtor has filed under the Companies’ Creditors Arrangement Act (CCAA), or under the Bankruptcy and Insolvency Act (BIA), Argo Partners has the resources to quickly research a debtor filing, and provide the creditor with a competitive quote on their respective claim.

The transfer process can vary from case to case and sometimes from Province to Province, but would typically involve the execution of a standard Assignment of Claim Agreement, the timely filing of a Proof of Claim, and the notification of the appropriate Monitor, Receiver, or Trustee of the claim assignment.

Agreements are expressed, and payments are made, solely within Canadian dollar terms, eliminating the need for extra costs and delays that can be associated with foreign currency exchange.
