Trial and Appellate Litigation Funding
Argo Partners began providing litigation financing over ten years ago, initially with a focus on appellate matters. Over time, we have expanded our funding efforts to include funding plaintiffs and counsel at both the trial and appellate levels in state courts, federal courts, regulatory proceedings, and arbitrations (both domestic and international) across all manner of claims, ranging from complex commercial to product liability to personal injury.
What distinguishes Argo Partners from many other litigation funders is our middle market presence: we provide up to $500,000 in non-recourse funding per investment (and above in certain limited situations). Most dedicated litigation funders do not consider investments below $1 to 2 million, a critical market gap that we serve to fill.
Argo Partner’s litigation funding is non-recourse, permitting recipients to mitigate litigation risk while applying funds to personal or business expenses, or towards the costs of litigation. Funding also maximizes litigation recoveries by affording recipients the opportunity to retain high quality counsel, consultants, and experts who would otherwise exceed litigation budgets. When provided to attorneys retained on a full or partial contingency basis, funding reduces financial risk, assists cash flow management, and incentivizes additional retentions by counsel to grow revenues.
While the terms for each funding vary, Argo’s recovery is typically structured as a low multiple of its investment, increasing over time. Recognizing the urgent liquidity needs of many litigants and counsel, we quickly complete our diligence and funding decision-making process. We are happy to discuss how litigation funding may assist you or your client in any pending matters.
Bankruptcy Litigation Funding
Building on our core business of investing in claims in Chapter 7 and 11 bankruptcies, Argo Partners provides litigation funding on an individual and portfolio basis to all stakeholders in bankruptcy proceedings, including debtors, creditors, trustees, and their counsel. Bankruptcy marks an underserved and critical area in litigation finance, where well-founded litigation claims frequently are not pursued due to a lack of resources. With over 30 years’ experience in the bankruptcy field, combined with our successful funding of many non-bankruptcy litigations (discussed above), Argo’s bankruptcy litigation funding affords recipients the opportunity to monetize meritorious claims for the benefit of creditors and debtor estates.
